Terms and Conditions
Thanks for visiting sendoptics.com. Use of this web site is subject to the terms and conditions below. It is a condition of entering into any contract with us that you accept these terms and conditions. We may make changes to this site and the details displayed on it and so the acceptance of these terms and conditions must be renewed every time you place an order.
Important. For ALL customers, when you place an order for prescription contact lenses we will need to see a copy of your most recent contact lens specification which must be less than 12 months old. This specification will be examined by our in-house opticians.
1. Prices and Payment
The prices shown on the site are inclusive of VAT. Delivery will be FREE on all orders. Sendoptics.com cannot accept your order until you have paid for it in full. We reserve the right not to supply you at our discretion - and we draw your attention to our notice concerning valid prescriptions.
If you wish to cancel your order, you must return to us any goods that have
already been supplied to you in its original packaging and unopened within
14 days. If you believe the goods to be faulty, incorrect or damaged upon
delivery, we will cover the cost of return (provided that the means of return
is agreed by us) and we will replace or exchange any such goods or we will
refund you what you have been paid, including carriage costs. Our policy
does not affect your statutory rights. We exclude liability to the full
extent that is permitted under the Unfair Contract Terms Act 1977 and the
Unfair Terms In Consumer Contracts Regulations 1999 for any loss of profits,
inconvenience, disappointment, indirect or consequential loss or damage
arising out of any problem in relation to the goods.
Unused goods
If for any reason you are not satisfied with your purchase from Sendoptics a full refund will be made within 14 days for goods which are unused (this excludes delivery charges).
No refunds will be made for products which has evidently been used.
Refunds for delivery charges will only be made when we have mistakingly sent the wrong goods to the customer.
Faulty goods
If the goods ordered prove to be faulty please return them to the address printed below. On receipt of the goods we will return them to the manufacturer for either replacement or repair and the replaced item will be forwarded to you as soon as possible.
Returning a product
All returns must be authorised by our returns department. Once your package has been given authorisation please send your unused or faulty product(s) to the address below. Please include a covering note with your name, address and order number. Please explain the action you would like us to take. We recommend that you use a reputable courier (e.g. Business Post, Parceline) for larger items and Royal Mail Special Delivery for smaller items. We can accept no responsibility until a member of our staff has signed for receipt of the goods.
4. General
We will not be liable to you where we are unable to fulfil any of our obligations to you as a result of any circumstance or cause beyond our control. Any part of these terms and conditions found to be unenforceable as a matter of law (or for any other legitimate reason) shall not prejudice the enforceability of all other terms and conditions which will not be affected and remain in full force.
These terms and conditions and any contract between us shall be governed by and construed in accordance with English law and the English Courts shall have jurisdiction over any disputes between us.
5. Product Availability
If any of the goods you order are not available to be delivered within our normal delivery timescale, for whatever reason, we will inform you of the position by e-mail or by telephone and if you wish, we will cancel your order and refund you anything that you have paid to us.
6. Refunds
Refunds will be made by re-crediting the payment card account from which the money was originally debited, or if you paid by cheque, by crediting the local branch of your Bank with the equivalent amount. All refunds will be made within 28 days of the cancellation of your order, for whatever reason (subject to your compliance with the terms and conditions relating to the return of goods).
Sendoptics.com respects your privacy. We will not give any information you provide to anyone else and we do not sell, rent, loan or otherwise part with it unless you consent to us doing so. From time to time, we may also want to provide you with updates on our services and special offers, but if you do not wish to receive notifications of these, please email us at unsubscribe@sendoptics.com and we will be happy to remove you from our mailing list.
8. Changes to Our Terms and Conditions
Any changes to our terms and conditions will be shown on these pages when you next order.
Unless indicated to the contrary, all materials on this site including design, text, graphics and photographs are the copyright of sendoptics.com. sendoptics.com is the owner of the trade marks appearing on this site and all associated trade names, logos and devices unless indicated to the contrary. All other trade marks, logos and names appearing on this site are the property of their respective owners, as indicated. You may download and print extracts from this site for your personal use only. No right, title or interest in any downloaded materials or software is transferred to you by such downloading. You may not make any other use of material on this site (including reproductions, except as mentioned above, publications, alteration or distribution) without sendoptics.com's prior written consent.
10. Security
sendoptics.com site uses 128 bit encryption to protect your personal card information. Every transaction that is processed will also be checked to eliminate card misuse. If, after all our checks, it is confirmed that your card details have been used fraudulently to obtain goods from sendoptics.com, we will refund to you any money received by us, subject to your having satisfied your card issuer's requirements.
11. Warranty
Sendoptics.com warrants that the products to be delivered comply with the agreement between Sendoptics.com and yourself and with the specifications in your prescription ("Warranty"). However, Sendoptics.com may not be held responsible if your eyes do not tolerate any contact lenses or any related products ordered by you.
If it becomes evident within 30 days of delivery that the contact lenses you have ordered fail to meet the Warranty you should return them immediately to Sendoptics.com. Please refer to the Returns Policy. You may request that Sendoptics.com replace the contact lenses concerned instead of issuing a refund.
The Warranty will not apply if a defect has arisen due to any improper use by you of the contact lenses and any related products or if you or a third party without Sendoptics.com' written permission, modified them or attempted to modify them or used them for purposes for which they are not intended.
The Warranty does not affect your common law or statutory rights.
